cooptação de parlamentares, a deslavada compra de consciências, a cínica
postura no negligenciamento das leis que caracterizam o seu governo, e por
outro lado aparece como salvador missionário do povo mais necessitado, a
quem engana com a bolsa família, a luz para todos e a venda da imagem que
o País vai muito bem e dentro de cinco anos será uma das cinco mais
poderosas Nação do mundo.
Como em cinco anos iremos reverter a nossa posição relativa às demais
Nações do mundo registrada pela UNESCO, pelo FACTBOOK 2009, e outros
institutos nacionais e que abaixo especificamos para refutar as falas
presidenciais :
A UNESCO aponta o Brasil face ao mundo na 80ª posição em educação, na 107º
posição no analfabetismo, no15º lugar na taxa de repetência, na 10ª na
economia;
O FACKBOOB (Almanaque Anual da Cia dos EUA) 2009 registra as seguintes
posições do Brasil em face do mundo: 5º em população e área; 10º na
economia, 67º no saneamento; 70ª no IDH ( Índice de Desenvolvimento Humano
); 81º em crescimento; 96º na taxa de inflação; 103º na renda per capita;
106º no alfabetismo; 112º na expectativa de vida; 120º em investimento;
109º na distribuição de renda;
Outros institutos nacionais (IPEA, IBGE, etc.,) registram: ocupamos o 72º
lugar em competitividade global ( México ocupa o 52º, a Índia o 48º, a
China o 34 º, o Chile 26º); nossa carga tributária aproxima-se dos 40% do
PIB, sendo uma das maiores do mundo; a média da formação bruta de capital
é de 19% ( FBEF), enquanto a dos países desenvolvidos é de 22% do PIB;
ocupamos a 72º posição mundial na corrupção , com perdas estimadas em 50
bilhões de reais por ano; o Congresso Nacional é o mais caro do mundo com
um orçamento disponível de 6.5 bilhões de reais , o da Itália é de 3,9 , o
da Alemanha é de 3,4 , o do México é de 1,9 , o da Argentina de 1,3, e da
Espanha é de 0,9 milhão; os custos salariais mensais de deputados,
senadores e ministros do Supremo Tribunal, embora que nominalmente
diferentes, são de fato equivalentes e representam 220 vezes o valor de um
salário mínimo; o custo na logística dos transportes é de 13% do PIB
enquanto nos EUA esse custo é de 8%.
Esses dados acima são irrefutáveis e que não poderão ser radicalmente
modificados em apenas cinco anos para que o Brasil se torne a quinta
potência mundial como o Presidente afirma na mídia e nos “comícios” em
milhares de localidades que visita, entre um pouso e outro do “Aérolula”,
com uma frequência de até 4 pousos por dia. Toda a ênfase na mentira, na
corrupção, na subversão, vem rendendo ao Presidente uma popularidade que
alcançou 84% no universo do público “cuidadosamente” selecionado para
pesquisa-o povo menos esclarecido.
Por que o povo esclarecido e o Congresso aceitam este estado caótico da
ética e da conjuntura Nacional?. Por que essa permissividade das elites não
contaminadas com os atos indecorosos do governo? E por que o Congresso
aceita ser cooptado ?
Brasileiros! Só há um caminho – arregimentar as elites não contaminadas –
para esclarecer o povo a fim de não eleger e/ou reeleger representantes
corruptos, criminosos e “contaminados…

Honmduras – O fundamento legal omitido
De Dalmo de Abreu Dallari, jurista, no site Observatório da Imprensa:
Quando a imprensa afirma que um ato de autoridade foi inconstitucional ou ilegal deve apontar qual o artigo da Constituição ou da lei que foi desrespeitado, para permitir aos destinatários da notícia sua própria avaliação e uma possível reação bem fundamentada.
De modo geral a ofensa à Constituição e às leis é sempre grave, num Estado Democrático de Direito. A par disso, toda a cidadania tem o direito de controlar a legalidade dos atos das autoridades públicas e para tanto precisa estar bem informada.
Um caso atual e patente de imprecisão nas informações está dificultando ou distorcendo a avaliação dos acontecimentos de Honduras. Grande parte da imprensa brasileira apresenta o presidente deposto Manuel Zelaya como vítima inocente de golpistas, mas quase nada tem sido informado sobre os aspectos jurídicos do caso.
Uma omissão importante, que vem impedindo uma avaliação bem fundamentada dos acontecimentos, é o fato de não ter sido publicada pela imprensa a fundamentação constitucional precisa da deposição de Zelaya, falando-se genericamente em “golpistas” sem informar quem decidiu tirá-lo da presidência, por que motivo e com qual fundamento jurídico. Esses elementos são indispensáveis para a correta avaliação dos fatos.
Com efeito, noticiou a imprensa que a Suprema Corte de Honduras ordenou que o Exército destituísse o presidente da República. É surpreendente e suscita muitas indagações a notícia de que ele foi deposto pelo Exército por ordem da Suprema Corte.
Pode parecer estranha a obediência do Exército ao Judiciário para a execução de tarefa que afeta gravemente a ordem política, o que, desde logo, recomenda um exame mais cuidadoso das circunstâncias, para constatar se o que ocorreu em Honduras foi mais um caso de golpe de Estado.
É necessária uma análise atenta, para saber de onde vem a força da Suprema Corte para ordenar a deposição de um presidente eleito e ser obedecida pelo Exército. A par disso, é importante procurar saber por que motivo e com que base jurídica a Suprema Corte tomou sua decisão e ordenou ao Exército que a executasse.
Segundo o noticiário dos jornais, o presidente deposto havia organizado um plebiscito, consultando o povo sobre sua pretensão de mudar a Constituição para que fosse possível a reeleição do presidente da República, sendo oportuno observar que este seria o último ano do mandato presidencial de Zelaya.
Ora, está em vigor em Honduras uma lei, aprovada pelo Congresso Nacional, proibindo consultas populares 180 dias antes e depois das eleições – e estas estão convocadas para o mês de novembro. Foi com base nessa proibição que a consulta montada por Zelaya foi declarada ilegal pelo Poder Judiciário.
Um dado que deve ser ressaltado é que a Constituição de Honduras estabelece expressamente, no artigo 4º, que a alternância no exercício da Presidência da República é obrigatória. Pelo artigo 237 o mandato presidencial é de quatro anos, dispondo o artigo 239 que o cidadão que tiver desempenhado a titularidade do Poder Executivo não poderá ser presidente ou vice-presidente no período imediato.
Outro ponto de extrema relevância é que a Constituição hondurenha não se limita a estabelecer a proibição de reeleição, mas vai mais longe. No mesmo artigo 239, que proíbe a reeleição, está expresso que quem contrariar essa disposição ou propuser sua reforma, assim como aqueles que o apóiem direta ou indiretamente, cessarão imediatamente o desempenho de seus respectivos cargos e ficarão inabilitados por dez anos para o exercício de qualquer função pública.
Reforçando essa proibição, dispõe ainda a Constituição, no artigo 374, que não poderão ser reformados, em caso algum, os artigos constitucionais que se referem à proibição de ser novamente presidente. Essa é uma cláusula pétrea da Constituição.
Foi com base nesses dispositivos expressos da Constituição que a Suprema Corte considerou inconstitucional a consulta convocada pelo presidente da República e fez aplicação do disposto no artigo 239, afastando-o do cargo.
Note-se que a Constituição é omissa quanto ao processo formal para esse afastamento, o que deve ter contribuído para um procedimento desastrado na hora da execução.
Tendo em conta que o respeito à Constituição é fundamental para a existência do Estado Democrático de Direito, não há dúvida de que Zelaya estava atentando contra a normalidade jurídica e a democracia em Honduras. A falta de informações completas e precisas sobre a configuração jurídica está contribuindo para conclusões apressadas que desfiguram a realidade.

Acabou-se tudo? As carreiras de Estado estão sendo levadas a servir ao governo e não ao Estado Brasileiro. Corremos um perigo de nos tornar uma outra república de banana. Já se fala há muito tempo que o governo corrupto, comunista e corruptor do Brasil atual, vem buscando, com êxito, atingir este objetivo.
O desgoverno que aí está já conseguiu que o seu serviço de informações se tornasse uma máquina ao seu dispor para encobrir mentiras e roubos no serviço público. O triste é que o chefe do serviço seja um general que jamais deveria se prestar a papel tão degradante como este. As estrelas de general eram sagradas na defesa da Pátria e não de grupos que ocupam o governo temporariamente.
Tentaram tornar a nossa Polícia Federal em um órgão para servir ao Ministério da Justiça. Quase que desmoralizam aquela Instituição, tão importante ao Brasil. No momento atual, tendo no ministério da justiça um dos homens mais COMUNISTA que há, podendo ser comparado a Béria ou Iejov (CHEFES DA KGB), corre o perigo de ser descaracterizada. A esperança dos brasileiros é que a grande maioria de seus homens possui caráter reto e consciência profissional.
Tentaram e tentam acabar com as FORÇAS ARMADAS de qualquer maneira. Os primeiros ministros da defesa eram abaixo da crítica. Foram procurar no que havia de pior. Uma lástima. O Dr Nelson Jobim, no começo andou se perdendo, mas com a convivência sentiu que o militar só pensa na Pátria e tem nojo dos homens mentirosos e sem caráter, aliás, o que é freqüente no governo atual do Brasil. Deus parece que veste verde e salvou o Exército. O antigo comandante era chamado general PT. Quase acaba com tudo Vendeu-se por um emprego na Petrobrás de 76 mil reais. Foi substituído por oficial general de fina educação, de caráter cristalino e que ama o Brasil e não partido político.
O Itamaraty chegou a tal ponto de desgraça que já nos corredores se encontram embaixadores com estrelas do PT na lapela. Pobre Rio Branco e pobre MRE. Desceu ao fundo do poço e já se fala que é uma sucursal do serviço exterior de Hugo Chavez. São defensores das Farcs e não do Brasil.
Agora, tentam deletar a Receita Federal. Aquilo foi o fim de tudo. Mentiu o Presidente, a ministra da casa civil, o general do serviço de informações e querem destruir a credibilidade da RECEITA FEDERAL. Vai trabalhar este Órgão, agora, para a eleição de 2010? Quem não for do PT, mas ajudar, não terá suas contas fiscalizadas, podendo fazer o que desejar, até receber presente em dólares, mesmo na cueca?
